You will be asked to expressly agree to these terms of sale before you place an order for our services.


Interpretation
In these terms of sale, "we" means Brilliant Domestic & commercial Cleaners (and "us" and "our" will be construed accordingly); and "you" means our customer or potential customer for our services (and "your" will be construed accordingly).
These represent a contract. This contract is made between Brilliant Domestic & commercial Cleaners and you the Client. You agree that any use of the services provided by Brilliant Domestic & commercial Cleaners shall constitute your acceptance of the Terms and Conditions. We agree to perform the work specified by you in a professional manner using every care to complete our service in accordance to our Terms of Business.

Payment

Payment will be due on completion unless agreed in advance by us. Payment can be cash or cheque (supported by value on Cheque Guarentee card)
For commercial or regular customers, at our discretion we may agree to open an account for you, enabling you to pay in arrears. Where you hold an account, then upon or following the completion of our services, we will send to you an invoice for payment of the price of those services, and you will pay such invoice within [14] days of the date of the invoice. Accounts will be subject to such credit limits as we may notify to you from time to time. If you do not pay any amount properly due to us under or in connection with these terms of sale on time, we may: charge you interest on the overdue amount at the rate of [8]% per year above the base rate of [HSBC Bank Plc] from time to time (which interest will accrue daily until the date of actual payment, be compounded quarterly, and be payable on demand); or claim interest and statutory compensation from you pursuant to the Late Payment of Commercial Debts (Interest) Act 1998.] Any late payments will also negate any discounts offered and the full cost will be then become payable.
We reserve the right to pass any unpaid accounts/debts to a third party debt collection agency. If we find it necessary to do this we will add our own administration charge of £70 there may be further charges added by the collection agency. By accepting our terms and conditions you agree to be bound by these terms and conditions and accept these charges.


Cancellation


Domestic & Contract Cleaning
You may cancel a cleaning visit or visits by giving at least 24 hours advanced notice. You may be able to terminate the contract cleaning service by giving one month (30 days) advanced notice in writing and specifying the last cleaning date subject to the terms set out in the contract.
You agree to pay the FULL price of the cleaning visit if you cancel or change the time less than 24 hours prior to the scheduled appointment. You agree to pay the FULL price of the cleaning visit in the following events: no one home to let them in, problem with  keys or lack of utilities e.g. no water or electricity available at the premises. (Minimum cancelation fee 2 hours at the agreed hourly rate).


Pre/End of tenancy cleaning
You may cancel the scheduled cleaning job by providing at least 24 hours’ notice prior to the agreed start time. The Client agrees to pay 50% of the initial quote as a cancellation fee if you cancel or change the date/time less than 24 hours prior to the scheduled appointment. You agree to pay the FULL price of the cleaning quote in the following events: no one home to let our cleaners in, problem with keys or lack of utilities e.g. no water or electricity available at the premises.


Complaints and Claims
In the unlikely event that damage or theft occurs, it must be reported within 24 hours of our service date. No claims will be accepted beyond this time. In case of poor service, we will rectify problems as soon as possible. Our cleaners must be allowed to return to rectify any issues; otherwise no refund can be claimed due to the nature of the service. You or a representative must be at the premises at the time of completion of the job so an inspection can be done and any correction is made on site on the same day.
In case of damage or breakage we will repair the item if possible or will credit the Client with the item's present value upon payment of cleaning services rendered subject to the limits below. All fragile and high value items must be secured or removed prior to our cleaning services. Items excluded from liability are: cash, jewellery, items of sentimental value, art and antiques.
We are responsible for damages up to £250, if reported within the 24 hours timeframe. Damages with a value higher than £250 are covered by our insuranceand not covered by us. The Client agrees to provide us with all required information regarding damages caused by our cleaners e,g receipts any possibly proof our staff caused the damaged. Key replacement or locksmith fees are paid only if keys are lost or broken or damaged by our staff. There is a £25 liability limit for keys lost by us or locksmith charges.


We are not to be responsible for:


• Delays due to events beyond our control (see section Force majeure)
• Lack of utilities.
• Work not completed to a good standard if a third party is working or present at the property when our cleaners are onsite which hinder our progress.
• Existing stains or damage.
•Damage to articles of a delicate nature that have not been removed prior to our visit. We reserve the right in this case to not clean an area but our full charges will still apply.
•Any damages caused by faulty equipment and cleaning materials provided by the Client.


Consumers: statutory rights
Nothing in these terms of sale affects any statutory rights you may have as a consumer.


Force majeure
In this Section and Section [15] below, “force majeure event” means:
(a) any event which is beyond our reasonable control;
(b) the unavailability of raw materials, components or products; and/or
(c) power failure, industrial disputes affecting any third party, governmental regulations, fires, floods, disasters, civil riots, terrorist attacks or wars.
Where a force majeure event gives rise to a failure or delay in us performing our obligations under these terms of sale, those obligations will be suspended for the duration of the force majeure event.
[If we become aware of a force majeure event which gives rise to, or which is likely to give rise to, any failure or delay in us performing our obligations under these terms of sale, we will notify you forthwith.]

Limitations of liability
Nothing in these terms of sale will limit or exclude your or our liability for: (i) death or personal injury caused by negligence; (ii) fraud or fraudulent misrepresentation; or (iii) any matter for which it would be illegal to limit or exclude, or attempt to limit or exclude, liability.
Subject to this:
(a) We will not be liable for any losses arising out of a force majeure event;
(b) if you are a business customer: we will not be liable for any loss of income or revenue, loss of business, loss of profits or contracts, loss of anticipated savings, loss of data or waste of management or office time, or loss of goodwill or reputational damage.

These terms of sale will be governed by and construed in accordance with English law, and the courts of England and Wales will have non-exclusive jurisdiction to adjudicate any dispute arising under or in relation to these terms of sale.
